stata 7 to 8 since I last used it. Has anyone else struck this problem
or knows how to fix it? I realise i could use the official merge command
but I quite liked the mmerge version.

I notice there is a newer version (2.5) of this program than that which was originally published. You might try -findit mmerge-, download the latest if you don't already have it, and see if that solves your problem.
